A federal judge in Washington has issued a decision that invalidates the U. S. Food and Drug Administration's (FDA) decision to sell generic Viagra.
Under the terms of the drug label, the Food and Drug Administration (FDA) is required to approve a generic drug for sale for an unapproved use, even if that use is in the same therapeutic category as that used by the drug's active ingredient.
In the case of Pfizer Inc. v. Merck & Co. Inc., et. al., et. al., Pfizer Inc. al., the court ruled in favor of Pfizer, holding that the FDA's decision to allow a generic drug for unapproved use is an abuse of discretion and therefore not unlawful under the law.
Plaintiffs claim that the FDA failed to adequately explain the FDA's decision to allow generic Viagra, which is not approved for sale without a prescription from a physician. The FDA's response to plaintiffs' claims is a request for an order granting a preliminary injunction to temporarily restrain the sale of all prescription drugs, including Pfizer products.
In their complaint, plaintiffs contend that the FDA's decision to allow generic Viagra should be reversed because it "should have required a medical expert to conduct a thorough medical analysis and discuss the evidence submitted by plaintiffs and the risks associated with using this drug."
The court in its opinion issued on March 25, 2008 issued the following order:
In a decision on the appeal, the FDA issued a decision that found that the FDA's decision to allow generic Viagra was an abuse of discretion, in violation of the Federal Food, Drug, and Cosmetic Act (FDCA), which prohibits the sales of drugs for human use.
In a letter to the FDA dated October 22, 2008, the FDA stated that it is concerned that the "label of the drug in the FDA package inserts may be confusing or vague in this regard." The FDA added that it believes the insert is "in violation of FDA regulations."
The FDA, however, had not made a finding of facts, in the final decision, and in the order issued on March 25, 2008, it found that the insert does not meet the requirements of the FDCA, the FDCA's purpose of which is to "ensure that the product(s) is approved and that there are no serious side effects from its use."
The court in its opinion noted that plaintiffs had submitted two documents to the FDA, one of which states that Pfizer had approved Viagra as a treatment for erectile dysfunction and the other "has not submitted any documentation to the FDA." The court found that the FDA was aware of the FDA's decision to approve Viagra and, thus, it was entitled to judgment for its decision.
Plaintiffs claim that the court's opinion in this case is not helpful. They say that the FDA's decision to approve the generic product is an abuse of discretion and therefore not unlawful.
Plaintiffs claim that the FDA has the right to "inform the FDA to take action to remedy violations of its own regulations, to make appropriate, effective decisions and to take additional measures." They contend that the FDA is not a "person" and, thus, should be held to the same standards of law as that of other FDA authorities.
Plaintiffs, in their brief, assert that the FDA is required to be an "authorized agency" under the FDCA, and that the FDA is not required to comply with all of the criteria for approval of a drug to be considered approved for sale.
The FDA's decision to allow generic Viagra, which is not approved for sale, is an abuse of discretion and therefore is not unlawful. However, plaintiffs claim that the court's order is improper. The court's order, which was written by the defendants, does not comply with all the criteria for FDA approval of generic drugs.
In addition to the order issued by the court in the suit, the case, and the order issued by the defendants, the case is also the first time that a drug-marketing regulation has been struck down for its alleged anticompetitive intent.
Plaintiffs filed this action after the drug label was found by the FDA to be confusingly similar to a medication which plaintiffs argue is not approved for use in treating erectile dysfunction.
